Terms and Conditions for the Go Sober “Donor Challenge” Competition (the “Competition”)

By entering this competition, you agree to be bound by these terms and conditions.

1. This Competition is promoted by Macmillan Cancer Support, registered charity in England and Wales (261017), Scotland (SC039907), the Isle of Man (604) also operating in Northern Ireland; a company limited by guarantee registered in England and Wales (02400969), Isle of Man company number 4694F with registered office at 89 Albert Embankment, London, SE1 7UQ (‘Macmillan, we, us, our’).

2. Entry into the Competition will constitute acceptance of these terms and conditions (“Terms and Conditions”).

3. Competition participants must be aged 18+ and a resident in the UK, Channel Islands or Isle of Man to enter. Employees of Macmillan or any of its subsidiary or affiliated companies and anyone otherwise connected with operation or fulfilment of the Competition are not eligible to take part.

4. To enter the Competition, you must:

a. Donate to the Go Sober fundraising page of a Go Sober or Quit for October participant at www.gosober.org.uk.

b. Email [email protected] with the answer to the question “As of 18th October, 6,579 Soberheroes have made a donation to themselves. How much in total would it cost to give them all 14 nights off their challenge using the Sober October minimum value Golden Tickets?” and your name.

5. The Competition commences on Wednesday 20th October 2021 at 9am. Donations made before this date will not be counted. A donation in your name must be showing on a participant’s Go Sober fundraising page on www.gosober.org.uk and your answer to the question must be received by 11:59pm on Friday 22nd October 2021 also.

6. The first entrant whose answer is the closest to the correct answer to the question will be the winner. The entrant whose answer is the second closest will be the first runner-up.

a. If more than one entrant gives the correct answer, or more than one entrant gives the same closest answer, the winner will be the first person to give the answer. This also applies to the runner up.

7. The winner and runners up will be notified no later than 29th October 2021.

8. If the winners refuse or are unable to provide an eligible address for Macmillan to send the prize to by Friday 29th October 2021, Macmillan reserves the right to award the prize to another participant with the next closest answer to the correct answer or the next fastest correct entry.

9. The prizes to be won are:

a. First Prize: FITBIT Versa 2 with Amazon Alexa – Emerald & Copper Rose (Worth £118.99 inc VAT)

b. Runner-up Prize: Jlab Audio Go Air True Wireless Bluetooth In-Ear Headphones with Mic/Remote, Black (Worth £29.99 inc VAT)

10. The prizes are as stated and are non-exchangeable and non-transferable. By participating in the Competition, you agree that the prize is awarded on an "as is" basis, and that neither Macmillan nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize.

11. The prize will be sent to the individual who made the entry no later than Wednesday 1st December 2021

12. In the event that, for reasons beyond Macmillan’s reasonable control and not related to the winner, Macmillan is unable to award the prize as described in these Terms and Conditions, Macmillan reserves the right to award a prize of a similar nature and an equivalent value.

13. The provision of the prize does not imply endorsement by Macmillan of any third-party supplier of the prize or any third parties concerned in any way with the Competition.

14. By entering you agree that Macmillan may use your personal data for the purposes of administering the Competition and awarding the prize, including in particular emailing you to inform you that you have won a prize and requesting your address in order to send the prize to you. 15. Save where it has been negligent, Macmillan will not be responsible for any damage, loss or injury resulting from participants' entry into the Competition or for technical, hardware or software failures, lost, faulty or unavailable network connections or difficulties of any kind that may limit or prohibit their ability to participate in the Competition. Macmillan will not be responsible for any lost, damaged, defaced, incomplete, illegible, or otherwise unreadable entries.

16. Macmillan is not liable in contract, tort (including but not limited to negligence) or otherwise in connection with this Competition for loss of revenue, contract, profits, anticipated savings or loss of data, any special or indirect or consequential losses or any loss of goodwill or reputation. Nothing in these terms and conditions shall limit Macmillan’s liability for death or personal injury caused by its negligence, fraud or for any other matter for which liability may not be limited by law.

17. All Macmillan’s decisions in relation to the Competition are final in all matters and Macmillan will not enter into any correspondence with participants other than the Competition winners.

18. These Terms and Conditions are governed by English law. The courts of England and Wales shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Competition or these Terms and Conditions.
